Terms of Use
These terms are the agreement between the company using the TekPilot service (the Customer) and Divara Teknoloji ve Yazılım A.Ş. (Divara). By opening an account or using the service, you accept these terms.
1. Service
TekPilot is a software service that reads the emails and attachments arriving in the mailbox connected by the Customer and turns them into work items, tasks and missing-step alerts. Features and plan limits are stated on the pricing page and in your account.
2. Account and security
- The account is opened by a person authorised to act on behalf of the Customer. The Customer is responsible for its users' actions in the account.
- Two-factor authentication is mandatory for account owners. You must not share your password, and you must notify us immediately if you notice any unauthorised access.
3. AI outputs
- The fields and suggestions on work items are produced by AI and may be inaccurate or incomplete. They are marked in the application.
- Every action that writes outside TekPilot goes through Customer approval. Checking an approved action, and its consequences, are the Customer's responsibility.
- Missing-step alerts work by written rules; the absence of an alert does not mean that the work is complete.
4. Customer data
- The emails and attachments in the connected mailbox and the content produced from them (Customer Data) belong to the Customer. For Customer Data, the Customer is the data controller and Divara is the data processor. Divara processes this data solely to provide the service, in accordance with the Privacy Policy; it does not use it to train AI models.
- The Customer confirms that it is legally authorised to access the mailbox it connects and to have the personal data in it processed through this service, and that it has fulfilled its duty to inform the data subjects concerned.
- Divara may use the providers listed on the Sub-processors page and imposes on them obligations no less protective than those in these terms.
5. Prohibited use
You may not use the service to process unlawful content, to access another person's mailbox without authorisation, to test or circumvent the security of the system, to copy the service by reverse engineering, or to get around the limits. In such cases we may suspend the account.
6. Fees and payment
- Prices are in Turkish lira and are shown excluding VAT; VAT is added separately on the invoice.
- The subscription is paid monthly or yearly in advance and renews automatically from the same card through iyzico.
- Prices may be updated once every three months in line with exchange-rate changes. We give at least 30 days' notice of any change; the new price applies from the next period.
- The price of the Pilot plan is fixed for the term stated in the pilot agreement.
- If payment cannot be collected, a grace period of 7 days is given. At the end of that period the service is suspended; your data is not deleted. Details are in the Cancellation and Refund Terms.
7. Plan limits
Each plan has monthly limits on emails, AI usage, users and mailboxes. We warn you as you approach a limit. Once a limit is reached, AI processing of new emails stops until the end of the period; existing data and screens remain accessible, and the emails keep waiting in your mailbox. You can move to a higher plan at any time.
8. Trial period
New accounts can be tried free of charge for 14 days, and no card details are required. If no paid plan is chosen when the trial ends, the account is suspended; the data is retained and deleted within the periods set out in the Privacy Policy.
9. Term and termination
- The Customer may cancel its subscription at any time; the service continues until the end of the paid period.
- Divara may terminate the agreement in the event of a material breach of these terms that is not remedied within 7 days of notice.
10. Service continuity
We make reasonable efforts to provide the service without interruption and announce planned maintenance in advance. A committed availability rate is given only in writing, in Enterprise agreements.
11. Intellectual property
The TekPilot software, interface and brand belong to Divara. The Customer is granted a non-transferable right of use for the duration of the subscription, limited by these terms.
12. Limitation of liability
Neither party is liable for indirect damages or loss of profit. Divara's total liability arising from this agreement is limited to the fees paid by the Customer in the 12 months preceding the event that caused the damage. Cases of intent and gross negligence, and the statutory rights of consumers, are excluded from this limit.
13. Confidentiality
The parties keep confidential, also after the agreement ends, any information they learn during the agreement that is clearly understood to be confidential.
14. Changes
If we change these terms, we notify account owners by email at least 30 days before the change takes effect. If you do not accept the change, you may cancel before the effective date.
15. Governing law and jurisdiction
This agreement is governed by Turkish law. The Courts and Enforcement Offices of Elazığ (Elazığ Mahkemeleri ve İcra Daireleri) have jurisdiction over disputes. The right of consumers to apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and the Consumer Courts (Tüketici Mahkemeleri) is reserved.
16. Notices and contact
